Locke Meredith: Hello. I'm Locke Meredith and I have a Legal Lines Tip for you. Remember knowledge is power, and I want you to know if you have a property damage claim either from a car wreck or some other circumstances, Louisiana law gives you a lot of rights. Particularly it mandates that the insurance company pay you your property damage claim within 30 days after you give them sufficient proof of loss. Typically the injuries or the property damage issues are whether or not the vehicle can be repaired, or whether or not it's quote "totaled."
That is, the cost of repairing it is more expensive than just paying you what the value of the vehicle is. Unfortunately, what the insurance company often wants to pay won't even pay off the debt. Another issue often encountered is if they decide to repair the vehicle, it's now depreciating in value because it's been in a wreck. Another issue is loss of use. You're entitled to be paid for the time that you're without the use of the vehicle. So my Legal Lines Tip from me, Locke Meredith to you is, be sure you know your property rights.
